Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Wager ("Wager," "we," "us") governing your access to and use of the Wager website, app, and iMessage extension (the "Services"). By joining the waitlist or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

To use the real-money features of Wager, you must:

• Be at least 18 years old (or the age of majority where you live, if higher);
• Be physically located in an eligible jurisdiction at the time you play;
• Use one account, registered to you, with accurate information; and
• Not be on any sanctions or self-exclusion list, and not be a prohibited person.

We may verify your age, identity, and location and may suspend or close accounts that do not meet these requirements.

2. Skill-based contests

Wager offers contests in which the outcome is determined predominantly by player skill. A contest ("Match") is a head-to-head game in which players use their skill to achieve a score. Matches are not games of chance, lotteries, or sports betting, and Wager is not a casino or sportsbook.

3. Wagers, escrow & payouts

• Funds are held in your own self-custodial wallet. When you enter a Match, your stake locks into an on-chain smart-contract escrow. Wager never takes custody of your funds.
• When a Match resolves, the escrow pays the winner automatically. Wager charges a platform fee of 10% of the pot, disclosed before you confirm a Match.
• Deposits and withdrawals (fiat on/off-ramp) are handled by third-party payment partners under their own terms; we do not control their processing times or decisions.

4. Fair play & prohibited conduct

You agree not to:

• Use a VPN, proxy, or location-spoofing tool, or misrepresent your location;
• Collude, match-fix, intentionally lose, or use a Match to move funds to another person;
• Use bots, automation, exploits, or any unfair advantage;
• Create multiple accounts or let anyone else use your account; or
• Use the Services for money laundering or any unlawful purpose.

5. Disconnects & results

The server is the authority on Match outcomes. If you fail to submit a score, disconnect, or abandon a Match, your score for that Match may be recorded as zero. We may void a Match and return stakes where we detect an error, exploit, or violation of these Terms.

6. Responsible play

Only wager what you can afford to lose. We provide tools and information to support responsible play. If you need to take a break, contact support to set limits or self-exclude.

7. Disclaimers & limitation of liability

The Services are provided "as is" without warranties of any kind. To the maximum extent permitted by law, Wager is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amounts you wagered in the 30 days before the event giving rise to the claim.

8. Dispute resolution

Except where prohibited, any dispute will be resolved by binding individual arbitration, and you and Wager waive the right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by contacting us.

9. Changes & termination

We may update these Terms or the Services at any time. Material changes will be posted here with a new "Last updated" date. We may suspend or terminate access for violations of these Terms.
